Alec Baldwin's motion to dismiss the "Rust" crew's lawsuit is denied

The motion to dismiss the “Rust” crew’s lawsuit requested by Alec Baldwin has been denied by a New Mexico judge.

A New Mexico judge has rejected Alec Baldwin's requests to have a civil lawsuit brought by "Rust" cast and crew members dismissed on the grounds that the actor-producer neglected safety precautions and skipped necessary training prior to fatally wounding cinematographer Halyna Hutchins during a 2021 rehearsal on the set of the Western film.

Alec Baldwin and El Dorado Pictures initially moved to dismiss the complaint and stay the civil case pending the outcome of the criminal case.

Ross Addiego, Doran Curtin, and Reese Price, three members of the film crew who were working as independent contractors, are the plaintiffs in the complaint.

The machinery for moving the camera was made and run by Addiego. Curtin was in charge of managing the props and attire. According to court records, the lawsuit claimed that Price was in charge of the crew's management in the rigging department as well as the non-electric support equipment.

The gun fired while Baldwin was practicing a cross-draw, striking Hutchins and Souza. Joel Souza, the film's director, sustained a non-life-threatening wound.

Hutchins was flown by helicopter to the University of New Mexico Hospital in critical condition, where she subsequently passed away from her wounds, according to the sheriff's office.

In April, the criminal accusations against Alec Baldwin were withdrawn. Hutchins' death was the subject of two counts of involuntary manslaughter against Baldwin, 65.

Hannah Gutierrez-Reed, the set armorer for the movie, is accused of two counts of involuntary manslaughter in connection with Hutchins' passing. In June, she was also accused of tampering with the evidence.
