New Bill Aims to Protect Consumers, Especially Children, from Unsafe Hemp Products
Illinois Governor JB Pritzker has announced his support for proposed legislation that seeks to regulate the growing market of hemp-derived THC and CBD products, such as Delta-8. The new House Bill 4293 would impose stricter regulations on intoxicating hemp products, ensuring they are subject to the same oversight as legal cannabis under the Cannabis Regulation and Tax Act (CRTA).
The bill is a response to growing concerns over the safety of these products, which often resemble popular snack foods and have led to hospitalizations. Under the proposed regulations, intoxicating hemp products will only be available through licensed dispensaries and will face strict packaging, taxation, and testing requirements. The legislation will also impose a 21+ age requirement for consumers, preventing underage access to potentially harmful products.
Governor JB Pritzker highlighted the importance of closing the regulatory loophole that allowed these products to be sold outside of dispensaries, often in packaging that appeals to children. "This regulatory gray area has created a loophole that put Illinois consumers of all ages, but particularly children, in danger," JB Pritzker said. "We’re closing that loophole and protecting Illinoisans of all ages."
Lt. Governor Juliana Stratton emphasized that the bill is crucial for protecting public health, ensuring clear rules and safe practices in the hemp industry. With reports of over 9,000 cases of Delta-8 poisoning nationwide, including 41% involving children, this legislation seeks to make Illinois a safer state for all consumers.
