The show-cause notice from SEIAA receives NGT endorsement to ensure environmental protocol compliance in preconstruction phase for Bhubaneswar real estate development.
The Bhubaneswar-based real estate developer received rejection from the National Green Tribunal when they tried to appeal against the State Environment Impact Assessment Authority (SEIAA) Odisha show-cause notice. The SEIAA issued this notice following their discovery of environmental violations within one of the builder's large Kalarahanga housing development project in Bhubaneswar.
SEIAA identified several non-compliant conditions in the Environmental Clearance certificate through their analysis which mainly involved problems with DG stack height setpoints in Phase I and Phase II of the development. The developmental project contains Phase I with its 14-story tower and Phase II extends across six 16-story towers. SEIAA stopped Phase III construction after the builder failed to fix the environmental problems with 17 towers.
The developer filed an appeal to the NGT against the show-cause notice. SEIAA's authority was affirmed by the tribunal through its decision that legal challenges against show-cause notices were impossible to maintain. The tribunal defined the notice as only a procedure which did not constitute a final court order.
Eco-compliance maintains paramount significance for all real estate development projects according to this legal decision. The National Green Tribunal delivered a strong warning through their dismissal that realtors must follow environmental standards before insisting on taking legal actions in major construction projects.
