U.S. States Show a 129% Gap in Laws Holding Dangerous Drivers Accountable After Crashes

Law Ethics And Legal Services

U.S. States Show 129% Gap in Dangerous Driving Laws

Key Takeaways

  • Four states, Maine, New York, Oregon, and Virginia, lead the nation with the highest crash accountability scores of 80 out of 100, combining strong hit-and-run felony laws, strict DUI penalties, robust vehicular homicide statutes, and meaningful insurance protections.

  • Wyoming scores the lowest in the nation at just 35 out of 100, the only state where hit-and-run crashes are treated as misdemeanors regardless of injury severity.

  • Eight states scored 50 or below out of 100, revealing that nearly one in six U.S. states lack basic legal safeguards to hold negligent and reckless drivers fully accountable after serious or fatal crashes.

When a crash happens, the legal consequences a driver faces depend almost entirely on which state they are in. A new 50-state scorecard finds that accountability for dangerous driving varies by as much as 129% from the strongest states to the weakest, revealing a patchwork of laws that leaves millions of crash victims with dramatically unequal protections depending on where the collision occurs.

An analysis by Kuzyk Personal Injury & Car Accident Lawyers evaluated all 50 states across five key dimensions of crash accountability: hit-and-run penalty severity, DUI penalty strictness, vehicular homicide law strength, minimum bodily injury liability coverage requirements, and uninsured/underinsured motorist (UM/UIM) and personal injury protection (PIP) mandates. Each category was scored on a scale of 0 to 20, producing a composite accountability score out of 100 for every state.

Top 10 States With the Strongest Crash Accountability Laws

States With the Highest Accountability Scores

Four states, Maine, New York, Oregon and Virginia, lead with scores of 80. Alaska, Connecticut, Michigan, Minnesota and Missouri follow at 75, while Illinois scores 70. Maine and Oregon have broad manslaughter laws, while New York and Connecticut impose strict DUI penalties.

Looking at the study, David Rosen, COO and CSO at Kuzyk Personal Injury & Car Accident Lawyers, commented,

"The gap between states is significant. Higher-scoring states generally combine stricter DUI and hit-and-run laws with stronger insurance protections, while states scoring 50 or below may provide fewer legal and financial protections. Knowing your state’s laws can help crash victims understand their legal options."

States With the Lowest Accountability Scores

Wyoming ranks lowest at 35 out of 100, followed by Tennessee at 40. Colorado, Georgia, Iowa, Montana, New Mexico and Ohio score 50, while Delaware and Hawaii score 55. Wyoming’s 35 contrasts with the top score of 80, highlighting major differences in crash accountability and victim protections nationwide.

Methodology

The study assessed all 50 states across five crash-accountability categories, scoring each from 0–20 for a total of 100. It examined hit-and-run, DUI, vehicular homicide, liability insurance, and UM/UIM and PIP requirements. Higher scores indicate stronger protections and accountability. The findings may change as states update their laws and insurance requirements. The analysis is intended to highlight differences in how states address crash accountability and victim protection.
